Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the VolaryDDNS service operated by VolaryCloud ("us", "we", "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and token that you use to access the Service and for any activities or actions under your account. You agree not to disclose your password or token to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel subdomains at our sole discretion.

3. Service Description and Limitations

VolaryDDNS provides dynamic DNS services that allow users to map domain names to dynamic IP addresses. The Service is provided on an "as is" and "as available" basis without warranties of any kind.

We do not guarantee continuous, uninterrupted, or secure access to the Service. Operation of the Service may be interfered with by numerous factors outside of our control.

We reserve the right to impose reasonable limitations on the use of the Service, including but not limited to:

• Rate limiting of API requests
• Restrictions on the number of subdomains per account
• Limits on update frequency

4. Acceptable Use Policy

You agree that you will not use the Service for any purposes that are illegal or prohibited by these Terms. You must use the Service in compliance with all applicable local, state, national, and international laws and regulations.

Prohibited uses include, but are not limited to:

• Hosting or distribution of malware, viruses, or any malicious software
• Phishing, fraud, or deceptive practices
• Illegal content or services
• Sending unsolicited commercial messages (spam)
• Conducting or participating in denial-of-service attacks
• Mining cryptocurrencies without explicit permission
• Infringing on intellectual property rights
• Hacking or unauthorized access attempts
• Activities that pose a risk to the security or performance of our services or the services of third parties

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including removing offending content, suspending or terminating accounts, and reporting violators to law enforcement authorities.

5. Service Modifications and Termination

We reserve the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

You agree that we may, under certain circumstances and without prior notice, immediately terminate your account and access to the Service. Cause for such termination shall include, but not be limited to:

• Breaches or violations of the Terms or other incorporated agreements or guidelines
• Requests by law enforcement or other government agencies
• Discontinuance or material modification to the Service
• Unexpected technical issues or problems
• Extended periods of inactivity
• Engagement in fraudulent or illegal activities
• Non-payment of any fees owed by you to us

The Service and its original content, features, and functionality are and will remain the exclusive property of VolaryCloud and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of VolaryCloud.

7. Limitation of Liability

In no event shall VolaryCloud, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from:

• Errors, mistakes, or inaccuracies in content
• Personal injury or property damage of any nature whatsoever resulting from your access to and use of our Service
• Any unauthorized access to or use of our secure servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our Service
• Any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Service by any third party
• Any loss of data or content due to failures or errors in the Service

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

8. Indemnification

You agree to defend, indemnify, and hold harmless VolaryCloud, its parent company, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the Service.

9. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by VolaryCloud. VolaryCloud has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that VolaryCloud shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Complete Agreement

These Terms constitute the entire agreement between you and VolaryCloud regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
